The use of auto dialers in the education sector is primarily regulated by the Telephone Consumer Protection Act (TCPA) in the United States. The TCPA was enacted in 1991 by the Federal Communications Commission (FCC) to address concerns about telemarketing calls, faxes, and text messages.
 

Under the TCPA, certain restrictions are placed on the use of auto dialers. For instance, the Act prohibits the use of auto dialers to call or text mobile phones without prior express consent from the recipient. However, there are exceptions to this rule, especially in the case of 'emergency purposes.'

 

Exemptions for the Education Sector

Fortunately for schools and educational institutions, the FCC recognizes that they often need to send out mass notifications in emergency situations. As a result, the FCC provides exceptions to the TCPA's restrictions for calls made by or on behalf of schools.
 

These exceptions apply to "calls made for emergency purposes or calls made for reasons closely related to the educational mission of the school, and they do not contain an advertisement or constitute telemarketing". In other words, schools are permitted to use auto dialers to call or text students, parents, or staff without obtaining prior consent, provided the call or text is for an emergency or closely related to the school’s educational mission.

While there are exceptions for the education sector, it is still critical for schools and educational institutions to understand the laws and regulations related to the use of auto dialers. Failure to comply with the TCPA can result in hefty fines and even lawsuits. Therefore, it is recommended that schools consult with legal counsel to ensure they are in compliance with all applicable laws and regulations.
